摘要：随着国际经济全球化的不断发展，国际贸易日益频繁。有效率的大规模的国际间贸易，是促进全球经济发展所不可或缺的。在各种国际交易结算方式中，信用证(Letter of Credit)越来越占据着主导地位。信用证从其创立至今，逐渐发展成为国际贸易结算中最流行的一种结算方式。然而，随着国际贸易和经济的日益繁荣，信用证欺诈也疯狂的蔓延起来，已经危机到整个国际间交易的正常运作机制，阻碍了国际贸易的顺利进行。本文拟结合案例对信用证运用中存在的欺诈风险进行分析，并提出相应的防范措施，分析相关的法律救济途径。

ABSTRACT：With the increasing economy globalization, international trade is becoming more and more frequent. Efficient large-scale international trade is indispensable to the whole capitalist society. Among all the international trade settlement ways, L/C (Letter of Credit) is becoming more and more dominant. From its establishment, L/C is gradually developed into one of the most popular settlement ways in international trade. However, with the booming of international trade and economic, L/C fraud is quickly spreading in all the world, which has done harm to the normal operation system of the international trade and hindered the smooth progress of international trade. This paper plans to use established cases to analysis some common L/C frauds existing in the operation of L/C and put forward the corresponding preventive measures, then discuss related legal relief ways.

本课题的主要内容分为四个部分。首先对信用证结算的基本内涵、基本特征、基本操作做一个简单的介绍。其次从三个不同的角度分析信用证欺诈：开证行面临的欺诈、开证申请人面临的欺诈、受益人面临的欺诈。再次，分析世界上主要国家关于信用证欺诈的防范措施以及相关法律救济方法。再为完善我国信用证法律救济制度提出相关的建设性建议，如完善相关法律，选择有诚信的合作伙伴，维护交易安全，防止信用证欺诈等。
