摘要：“少数人”在不同的语言环境中具有不同的含义。在现代民主架构中，人们在自由、平等的环境中行使自己的权利，选举自己认可的代表或者发表自己的言论，而体制为实现最终的决定选择多数人的意见作为最后的决议。现代民主架构中的“少数人”是社会主体在以有限多数原则为基础下，所产生的其意见、建议不同于相对多数人的群体。少数人权利的保护是现代民主的重要内容。少数人权利是个人权利，法律的规范性、稳定性是保护少数人权利的有效方式。同时，少数人权利的有效保障也有利于现代民主的更好发展。就少数人权利保护的现状来看，人们对国际法领域的少数人群体的保护比较关注，包括了从法理研究到法律制度完善的各个方面。对于现代民主架构中多数决下的少数人权利的保障则显得比较薄弱，大多流于形式。

Abstract: "Minority" in different contexts have different meanings. People exercise their rights in a free and equal environment in modern democratic. They elect representatives and express their views. To achieve the ultimate decision, people always choose the majority opinion as the final resolution. The "Minority" of modern democratic architecture are people who have the different opinions against the Majority. The protection of minority rights is an important part of modern democracy. Minority rights are individual rights. Normative and stability are the characters of law. And law is the good choose to protect minority rights effectively. The effective protection of minority rights is also good for the development of modern democracy. But now there are many laws and systems to protect the Minority, who belong to the international law. The rights of Minority, who have the different views in modern democratic structure, are protected weakly.
