摘要:随着人类辅助生殖技术的发展，给许多不孕不育的家庭带来了希望，其中有不少的人们选择了通过代孕的形式来达成延续后代的愿望。但同时代孕的做法给传统的伦理道德和法律制度都带来了严重的冲击。而我国也没有一部专门的法律法规对代孕行为进行规范，仅有卫生部颁布的《人类辅助生殖技术管理办法》，但其对代孕的相关问题都没有作出详细的规定，难以起到应有的制约作用，所以制定一部专门关于代孕的法律法规是非常有必要的。本文通过对代孕现象中凸现的法律问题进行分析研究，对国外相关的立法进行分析学习，最后提出对我国代孕制度的立法建议。

Abstract:As human assisted reproductive technology development, it bring hope to many sterility family, some of them chose the form of surrogacy to breed the next generation. However, the practice of surrogacy has brought serious impact on traditional ethics and legal system. And our country does not have specific laws and regulations on surrogacy conduct standardized, only the Ministry of Health issued Human Assisted Reproductive Technology Management Approach, which surrogacy related problems are not made detailed regulations, it is difficult to play its role in the constraints, so establish a special about surrogacy laws and regulations is very necessary. This article through to the surrogacy phenomenon appeared in the legal analysis of issues, and the relevant foreign legislation to analysis of the study, finally proposed to our country the surrogacy system of legislative proposals.

代孕是随着人类辅助生殖技术的发展而产生的。代孕冲击着人类传统的自然生育观念，与人们的传统伦理道德观念存在极大的差异，虽然反对的声音不断，但是由于各种的原因，人们对代孕的需求还是不断增多，代孕行为屡禁不止，同时商业性代孕中介机构也随之而生，为代孕双方牵线搭桥，从中谋取高额中介费。强制禁止代孕不但没有遏制到代孕行为，而且使代孕行为得不到监管，出现问题时无法可依，代孕当事人及代孕所生子女的利益得不到保障。我国应该跟上时代发展的步伐，以积极开放的态度去面对问题，制定一部符合我国国情的专门关于代孕的法律法规，对代孕行为进行严格监督管理，让代孕技术更好地造福人类。
