摘要：教师拥有一定限度的权力,从法律角度、社会角度、教师自身及学生的特点等方面来看，教师权力存在具有一定的合理性，但是这种权力要在一定范围内运用得当,部分教师却越过自己的权力范围,利用手中的特权随意惩罚学生，独断专权。教师这样对待学生的行为不但是违法的，同时与教育人道主义原则也是相悖的。教师拥有哪些合法权力？在学生学习过程中教师要如何行使自己手中的权力，才不会侵犯学生的合法权利？本文试图从教师权力滥用的现状着手，分析教师权力滥用产生的原因和危害，并提出预防此现象发生的解决方案，从而为教师如何合理运用权力、学生权利怎样才能免遭侵犯开拓新思路，以期对教育教学实践有所帮助。

Abstract：Teachers have certain power to some extent, From a legal perspective, social perspective, and in terms of characteristics of teachers and students, it’s rational,But this power should be used properly within a certain range, some teachers have over used their powers of punishment by the hands of the privileged students at random, arbitrary power. It’s not only illegal, but also inconsistent with the humanitarian principles of education. What legal right do teachers have? How do teachers use their power in the learning process will not infringe the legal rights of students? This article tries to analyze the reasons and dangers of this phenomenon from the present situation of the abused use of power, and propose preventive solutions to this phenomenon, so as explore new ideas on how to make rational use of power against violations of rights of students,and to provide help to teaching practice.

本课题提出的意义具体体现在以下两个方面。1、保护受教育者的合法权利不受侵害。教师有权利对学生进行教学指导，开展教育教学活动，但是由于许多客观方面的缺失导致教师越权，教师体罚、变相体罚学生和侮辱学生人格尊严等侵犯未成年学生合法权利。本课题的研究致力于使教师意识到要正确行使自己的权力行使限度和范围，从而保护受教育者的合法权利不受侵犯。2、保护教师的合法权益。教师权力的使用怎样才算合法？教师体罚学生、过度惩罚学生导致的教师滥用权力这一说法有损教师的良好形象，教师因此被社会舆论所批评，但产生这一现象的原因是什么？是否全是教师的错呢？并且我们该如何来预防这种现象再发生？这些问题的解决，有利于保护教师的合法权益。
