摘 要:“舆论监督”是中国特色的词组，在西方文献中并没有“舆论”和“监督”这样的固定搭配。它是社会监督的重要形式，是新闻媒体运用舆论的力量，帮助公众了解政府事务、社会事务和一切涉及公共利益的事务一项使命。随着政治文明的推进和人民群众法制、民主意识的提高，舆论监督越来越受到重视。在我国，舆论监督是群众舆论的反映和群众监督的体现，也是新闻媒介的一项神圣使命，表达的是人民的呼声、人民的利益和人民的意志。我国传统的舆论监督方式是通过报刊、广播、电视等大众媒体进行的。但是近几年传统媒体难以达到社会所希望的作用，许多重大案件都是通过网络曝光继而得到社会各界的广泛关注。随着舆论监督在现实中的作用越来越重要，在法律方面的不足凸显无疑。舆论监督法律关系在我国立法中只是散见于其他部门法的法条之中，新闻舆论法的制定已成为当务之急。本文通过对舆论监督的理性分析，从当前舆论监督的立法现实状况，结合国内外当前对舆论监督的法律规制来探讨舆论监督的作用及局限。

Abstract:"Supervision by public opinion" is the phrase of the Chinese characteristics, and fixed with "public opinion" and "supervision" in Western literature. It is an important form of social supervision, the news media to use the power of public opinion to help the public understanding of government affairs, social affairs and all matters involving the public interest on a mission. With the awareness of the advance of political civilization and the people of the rule of law, democracy, supervision by public opinion more and more attention. In China, the supervision by public opinion is a reflection of the opinion of the masses and the embodiment of the supervision by the masses, is also a sacred mission of the media, the expression of the voice of the people, the people's interests and will of the people. China's traditional way of public opinion through the press, radio, television and other mass media. But in recent years, traditional media is difficult to achieve the desired role of the social, many major cases then widespread concern in all sectors of society through the network exposure. With the increasingly important role of supervision by public opinion in reality, the lack of legal aspects will undoubtedly highlight. Supervision by public opinion legal relations in our legislation just scattered among the other departments of this law, the enactment of the law of the news media has become imperative. In this paper, the rational analysis of supervision by public opinion, from the current legislation of supervision by public opinion reality, at home and abroad legal regulation of supervision by public opinion to explore the role of public opinion and limitations.
